A quick update for anyone who might have had or be considering dealings with this chap...

It seems there IS a Cre8tive Solutions registered in the UK: This from Companies House.....

I've NO reason to believe there's ANY connection between this company and Jamie Kirk Esq; although I will be investigating this point properly. It's not unreasonable at this stage to suspect that there may be some element of 'passing off'. The address is also at variance with what I've seen on electronic stationary presented by Kirk as his "Registered Office"; that stationary presenting his business presence in a way which is at odds with statute.

We can only hope that Mr Kirk comes back to the forum to clarify the position. In the meantime it would seem that a degree of caution is indeed warranted in dealing with the fellow.

The Estetica Design Forum currently carries the thread to which the now banned member referred. Their search facility is open to guests. Rather than post a link to that forum (which seems less concerned with the defamation act than might be wise) I'll leave it up to interested parties to google and search their way to the appropriate post.

A month ago I answered THIS advert placed on Gumtree by Jamie Kirk. I don't see myself as an £8 an hour web designer but this was to be very my first ever professional assignment so I jumped at the chance to get my first project.

Upon reading the advert I visited cre8tive-solutions.com. I wasn't particulalry impressed with what I saw and wondered if he was for real as good webdesigners tend to have good websites, so I asked if we could meet up.

I went to his flat and was told that the job involved redesigning the cre8tive-solutions website. He said he wasn't a designer himself, that he was a business man, and that no one from the company had enough spare time to work on the company site and that was the reason it looked so shoddy.

He told me that he would pay on delivery and I just wanted the contract as I'm a new business so I accepted these unreasonable terms.

When I got home from that meeting I googled him and his company, and found that he had an account here so I read his posts (I remember reading this very post a month ago) and immediately wondered why he had told me that his company had been running for three years when so much of his internet activity seems to start around July/August 2008. I told myself he was probably referring to his parent company and not cre8tive when he spoke of his three years in the business.

So I got my head down, built the blog, services page, portfolio gallery, setup a cool project management tool and put it all on a subdomain of my sisters website so he could look at it. I went to his house a 2nd time and he told me he was happy with everything but that he wanted some other features to be added, stuff that would take me a week to do, and so I agreed to this as I was already halfway in.

Once I had done the things he asked, I emailed him to let him know and asked if we could arrange payment. He had been in regular contact with me up until that point but as soon as I mentioned money, he went silent.

After a week of this, I noticed that the cre8tive-solutions website had gone down and I had grown tired of waiting for my cash so I emailed him to let him know that I was removing the work from my test site and if he wanted me to finish the the project he would need to pay me up front.

A few day's later I got an email from him advising that he was sorry for the delay in getting back to me and that he had been moving house (for a week and a half??) and that he did want me to complete the work. He also told me that he still wanted me to make an SMS application that we had spoken about which was to be my second project for him.

I haven't heard from him since then, and that was last Friday morning, a week ago.

I have learned some very important lessons. Firstly, in my search for information on Jamie Kirk, I found this place!! I signed up for an account the other day and was planning on coming along and introducing myself tonght when I noticed this thread again.

Secondly, from now on, I want 40% cash upfront or I don't get out of bed.

Thirdly, I want a contract, I want it in writing or you can bolt.

I don't imagine I will get 'munsoned' like this again.

My only worry is that Jamie Kirk will resurface with a new name and another new compan (see his first 'webdesign company' here - they're called Thistle Web Design

And, as I said, from dealing with this guy and from tracking his moves online, I've discovered a whole host of interesting sites where I can promote my services and learn business tips from the likes of yourselves.

I could point you in the direction of a 1/2 dozen Jamie Kirks. Some are close to their 7th decade and are still scrabbling around playing the same old game they were 30 years ago. Some appear to be new entrants to the Arfur Daley school of business!

The B2B scene is Scotland is getting closer and closer as a community; which is a positive thing all round. For one it makes it harder for guys like this to just move from town to town playing the same old game. It's not about slagging people off. The guy who flagged this one up was just a bit rash in the way he went about it. There are pieces of this puzzle all over the net and beyond.

Still, positive things are coming out of it. It's slightly painful to watch the next generation learn the same lessons I did the same way I did (i.e. the hard way!). But lessons learn't the hard way are the ones that stick best.

I notice this guy has also been outed on UKBF and there is a link back to this. Starting a business is difficult enough and, like Matt and Stephen, I've been burned in the past as well. It is a difficult lesson to learn and as time goes on, you learn who you can trust. For B2B clients a deposit is the first thing on the list as far as I'm concerned although I broke that rule just this week. As Matt has said, the business community in Scotland is coming closer together, due to places like SBF, so hopefully people like JK will be outed before anyone suffers any hardship. Anyway, welcome to the forums Stephen.

I would like to point out to anyone that has been trying to "find me" in relation to outstanding payments that i have been moving property in recent weeks and can only access the internet online.

Stephen, i dont recall receiving a request for payment from you but i would have rejected in any case as:

Hi Matt

I did respond on the other site however i thought i should cover it here also.

I am curious as to the offences i have potentially committed and would love to have a chat with you over these things. Namely my use of the trading name Cre8tive Solutions. I wasnt (and still am not) aware that i was commiting an offence in my choice of the name James Kirk T/As Cre8tive Solutions. If i am committing an offence i will correct it straight away.

I have seeked legal advice on all comments that have come to my attention but, being pro active, i would like to straighten things out as quickly as i can.

The main point, from what i can gather, is people complaining at a lack of payment, which is fair enough, and will be rectified this coming monday. If there is anything else i am doing which is causing me to break the law i would of course act on it immediately.

The other issues you mentioned are not things i am familiar with (being admittedly illiterate when it comes to law). I have asked my solicitor but it was he who helped me start up and is actively involved in the day to day consulting of the company.

I would also like to confirm to everyone involved that i do not intend on closing down or ceasing to trade, i simply intend to resolve any issues that may be outstanding on a legal and/or reputable footing.

I would also like to point out that no invoice has been received from Stephen for this project. So it is unfair for this to be held against me. Im sure you wouldnt ask someone to pay for photographs that werent completely developed?

just to touch on this one

Tom, i had emailed you prior with details that i had instructed a copywriter to getin in touch with you directly but its now my undertstanding that this hasnt happened.

If you wish to use the idea feel free to get in touch as, you quite rightly stated, its my idea but your design.

From my discussions with my legal rep earlier the fact that theres an e-paper trail clearly stating my ideas to you is enough to justify me asking you not to go ahead with the EXACT idea. however the design is yours and i wouldnt lay claim to that.

For reference i use a mobile phone as i am not permitted to change my utility providers in my flat and being a start up cannot afford a commercial property in this climate

i will touch on a few things from this particular post.

A) If you dont see yourself as an £8 per hour web designer then dont take on the work. The fact that it was your first ever professional assignment fully justifies my offer of £8 per hour. You were with me face to face and didnt voice or imply any dissatisfaction at my offer.
B)I actually said that im not a designer myself so cant complete the site, and that i had offered it to other people who hadnt delivered accurately enough
C)You didnt voice any concern about payment on completion
D)I had told you that Cre8tive Solutions was formed in June/July of this year and that i had been in business for 3 years - which is correct
E)THe sms project is different and had only been mentioned as you said you could do this
F) I have received no invoice from you, and as such no payment is due. You havent even finsihed the work according to our terms.

All in all Stephen i feel i have placed the ball in your court. I am professional enough to honour my word and if you want to complete the project then feel free. If not, please spare yourself the blushes of making a public request for a payment you are not yet due
